General conditions of use of Klap.ro

I. General terms

Klap.ro is the trade name of Klap Tech SRL, a Romanian entity, having its registered office in Str. Turturelelor No. 48, Floor 1, Room 1.2A, Sector 3, Bucharest, 030882, registered under registration no. J2019016570409, having unique tax registration code RO 41981934, Site Administrator Klap.ro (hereinafter referred to as “Klap.ro”, “Society”).

Please read carefully the Terms and Conditions of use of Klap.ro services (hereinafter referred to as “Klap.ro“ terms and conditions) before using the services offered by Klap Tech SRL.

If:

You agree to be fully bound by the terms and conditions detailed in the present page you must check the box next to the words “I READ AND ACCEPTED THE TERMS AND CONDITIONS” on the accessed website. Any use by you of any services offered by Klap.ro signifies your acceptance, in full, of all the provisions of the terms and conditions of Klap.ro.

“Klap.ro terms and conditions” have contractual value, representing the contract that governs the relationship between Klap.ro and the User of our website (“User”), a contract that is accepted by the user through the simple use of the services offered by Klap.ro.

Acceptance of “Klap.ro” Terms and Conditions is expressly conditional upon your agreement to all terms and conditions of this Convention

To the extent that the User of the site wishes to become a Klap.ro customer and to benefit from the services offered by Klap.ro, the Agreement is completed with the Terms and Conditions on this site and together forms the contractual agreement between the parties. In this latter situation, the User of the www.klap.ro website becomes a Client (“”Client).

You do not agree with “Klap.ro terms and conditions” provided in the present page, you have the obligation to immediately cease any request/use of services offered by Klap.ro.

“Klap.ro terms and conditions” are applicable to all services performed by Klap.ro through our website (hereinafter referred to as “Site”).

Web page available at Klap.ro and all related web pages, such as the sections of the web page mentioned (“Site”), except those indicated differently, as well as all services offered by Klap.ro through the Site (“Services”), are owned and operated by Klap.ro and accessed by you in the following terms and conditions:

II. Definitions and terms

Klap.ro a legal entity operating and managing the Site, the online store hosted at www.klap.ro and its subdomains, which offer reconditioned and second-hand devices for purchase and sale, such as mobile phones and accessories.

User means any natural person over the age of 16 or a legal entity registered on the Site who, by completing the Account creation process, has given its consent to the site-specific clauses in section “Terms and Conditions” and who uses our site (hereinafter referred to as “User”).

The Customer may be any natural person over the age of 16 or a legal entity or any legal entity that has or obtains access to the CONTENT, by any means of communication made available by Klap.ro (electronic, telephone, etc.) or based on an existing user agreement between Klap.ro and this one and who makes an Account and has placed an order for the purchase of the Products and Services presented by Klap.ro in the Site www.klap.ro .

Buyer may be any natural person over the age of 16 or a legal entity or any legal entity that makes an Account on the Site and makes an Order.

The Seller may be any natural person over the age of 16 or a legal entity or any legal entity that makes an Account on the Site and wants to offer for sale a Product of those accepted by the Site to be subsequently purchased by the Buyer, upon acceptance by Klap.ro, depending on its own commercial policy.

Buyer may be any natural person over the age of 16 or a legal entity or any legal entity that makes an Account on the Site and makes an Order.

Order is an electronic document that intervenes as a form of communication between the Seller and/or the Buyer through which the Buyer/Seller sends to the Buyer/Seller, through the Site, that he wants to benefit from the services and products offered by Klap.ro

The commission is the amount owed by the Client and that Klap.ro returns as the price of the agency services provided to the Client by Klap.ro, calculated at the fixed amount.

Contract means the distance contract concluded in electronic form, these Terms and Conditions, between the Seller and/or the Buyer, without the simultaneous physical presence of the Seller and the Buyer.

Account – the section of the Site consisting of an e-mail address and a password that allows the Buyer and/or the Seller to submit the Order and which contains information about the Customer/User/Buyer/Seller and the history of the Buyer/Seller on the Site (Orders, tax invoices, goods guarantees, etc.). The User is responsible and will ensure that all information entered when creating the Account is accurate, complete and up-to-date

My Cart – section of the Account that allows the Buyer/User to add the Goods or Services that he wants to purchase at the time of addition or at a later time; if the Goods or Services are not purchased at the time of addition by making the Order, the Buyer/User will benefit from the service provided by the Seller to track the Goods and Services by receiving Commercial Communications from him.

Goods and Services – any product or service listed on the Site, including the products and services mentioned in the Order, to be provided by the Seller to the Buyer as a result of the Contract concluded.

Campaign – the action of exhibiting for commercial purposes, a finite number of Goods and/or Services having a limited and predefined stock, for a limited period of time set by the Seller.

Products and Goods under the title of “GIFT” represent the goods ”gift”, offered by Klap.ro as a result of the order made by the Customer on the website www.klap.ro . The product offered as a “gift”; if the purchased Good is returned and opts for the refund of the paid amount, it must be returned together with the Good, in the state in which it was delivered.

Gift Voucher is a voucher issued by Klap.ro and can be used exclusively for online orders on the www.klap.ro website and offers the Customer the benefits inscribed on it, under the conditions and restrictions explicitly mentioned in the email received with it. The Gift Voucher is valid for a single order, applying a discount equal to the value mentioned on it.

Review/feedback/appearance – a written evaluation by the owner or beneficiary of a Good purchased from www.klap.ro or the Service, evaluation based on personal experience and its ability to make qualitative comments.

Comment – critical-purpose review or comment on a Review or other comment.

Question – formula for addressing other Users/Customers/Buyers/Sellers in order to obtain information about the Goods or Services rendered/provided by Klap.ro.

Reply – written information that is passed on to the User/Customer/Buyer who has addressed a Question on the Site or page to a particular Good or an explanation provided by a User/Client/Buyer/Seller to another User/Customer/Buyer/Seller in a discussion.

Commercial communications – any type of message sent (such as: email/SMS/telephone/mobile push/webpush/etc.) containing general and thematic information, information on products similar or complementary to those you have purchased, information on offers or promotions, information on Goods and Services added in section “Account/My cart” as well as other commercial communications such as market research and opinion polls.

Transaction – collection or reimbursement of an amount resulting from the sale or purchase of a Good and/or Service by Klap.ro, the Buyer/Seller, by using the services of the card processor agreed by Klap.ro, regardless of the delivery method.

“PRP” (sau denumit “RRP”, după caz) – este un preț recomandat de revânzare al Bunului transmis direct de către producător, cât și, după caz, prin intermediul distribuitorului, furnizorului, Vânzătorului/Cumpărătorului, Prețul de Vânzare/Cumpărare fiind stabilit în mod independent de către Klap.ro, în funcție de propria să politică comercială. Scopul unic al aceste informații este de a sprijini Cumpărătorul/Vânzătorul/Clientul/Utilizatorul în decizia de cumpărare a Bunului. Cumpărătorul/Clientul/Utilizatorul/Vânzătorul înțelege că marcarea mai puțin evidență a acestei informații nu este de natură să producă confuzie și că, în luarea deciziei de cumpărare sau vânzare a Bunului, Cumpărătorul/Clientul/Utilizatorul/Vânzătorul trebuie să aibă în vedere strict Prețul de Vânzare/Cumpărare comunicat de către Vânzător/Cumpărător și solicitat de acesta din urmă Cumpărătorului/Clientului/Utilizatorului/Vânzătorului pentru Bunul comercializat sau Serviciul prestat.

Cut Price – represents the reference price, respectively the lowest price practiced by Klap.ro at least in the period of the last 30 days before the date of application of the price reduction on the Good or Retail price practiced by other traders for the newly sealed Good. Under the law, the Cut Price can be maintained also under the conditions of a successive, gradual reduction. The Cut price is valid within the limit of the available stock of the Good/Service.

Sale Price – represents the value of the Good, claimed and requested by Klap.ro, Buyer/Customer/User, highlighted accordingly on the product page of the Site, respectively in the presentation label for the products listed on the Site. Klap.ro can display distinctly, in a visible way, the value amount of the difference between the Sale Price and the PRP and/or the value difference, or percentage, between the Sale Price and the Cut Price. The Sale Price is valid within the limit of the available stock of the Goods/Services.

Estimated Price Offer – represents the initial price offer, calculated automatically by the Site, through a price calculator, communicated to the Seller, and which will be adjusted by Klap.ro, according to its own commercial policy, after receiving the Goods sent by the Seller, as a result of the Process of verification and validation of the information provided by the Seller in the Account created on the Site.

Price Offer – is the offer that will be communicated to the Seller after checking the Product that the Seller wants to list for Sale on the Klap.ro website. The price offer communicated by Klap.ro to the Seller may be established independently by Klap.ro, depending on its own commercial policy.

The Sale Price – is the amount that will be transferred to the Seller as a result of the Sale of the Product, following its acceptance by the Seller.

Green stamp duty – value expressed in lei, paid by the Seller to the authorized company with taking over the collection, transport and recovery/recycling of waste electrical and electronic equipment, as provided by the legislation in force.

Partner – represents the natural or legal persons with whom Klap.ro has concluded contracts or other types of agreements for the delivery of certain goods or services through the Site

Verification process – The set of actions underlying the technical, operational and aesthetic verification for the Products prior to the Sale on the Site.

Products – are electronic movable goods and accessories that can be put up for sale on the site to be bought.

Specifications – are the technical, operational and aesthetic characteristics of the Products listed on the Site. The text content and technical specifications presented on the site are informative and do not create contractual obligations (we do our best to make this information accurate and accurate).

Sale – is the operation by which a Product is purchased by the Buyer.

Regulations – any law, decision, judgment, ordinance, code, decree, rule, regulation or requirement issued, implemented, adopted, promulgated, implemented or otherwise adopted by or under the authority of any governmental body, or by any other regulatory body in the country where the Products and/or the European Union will be marketed;

III. Content, warranties and returns, Klap.ro policy

The content of any e-mail sent to Buyer and/or Seller by Klap.ro by electronic means and/or any other means of communication available;

Any information communicated by any means by an employee/collaborator of Klap.ro, the Buyer/Seller, according to the contact information, specified or not by him;

Information related to the Goods and/or Services and/or tariffs practiced by Klap.ro during a certain period;

Information related to the Goods and/or Services and/or tariffs charged by a third party with which Klap.ro has concluded partnership contracts, within a certain period;

Data related to Klap.ro, or other privileged data thereof.

Grading system – Klap.ro phones are divided into 4 degrees of aesthetics/letters, as follows:

The letter A+ is the equivalent of note 10 and is assigned to a refurbished device in perfect, exceptional condition that looks and works like a new, impactless, scratch-free device.

The letter A is assigned to a reconditioned device in very good condition, but you may notice a few small negligible scratches on the screen and on the back housing, but you will not find cracks or cracks.

The letter B indicates that the refurbished device is in good condition but shows visible traces of use. A few scratches on the screen, a few traces of wear or impact on the housing and frame, but they will not be deep enough to be felt to the touch and will not fundamentally impede its operation.

The letter C indicates a decent state and the fact that the device is restored to working condition. Scratches and marks of impact on the screen, back housing or marks of blows from the corners of the device indicate that the device has received a new life. Will not be present cracks or cracks

Klap.ro may at any time suspend or discontinue the availability of the Site, with immediate effect and without prior notice, for the purpose of performing updates, repairs or maintenance work or for the purpose of improving the performance of the Site.

Klap.ro will make every effort to ensure the availability of the Site and its use by the Client in a secure and confidential manner.

Klap.ro reserves the right to modify unilaterally and without prior notice the content, form of presentation and/or structure of the Site. The site contains links or references to other sites, for whose use the specific use policies of those sites apply, as they are specified on those sites. Klap.ro is not liable and does not assume any obligation for their content. Any inclusion of links in the Site is made solely to support the Customer and does not imply support by Klap.ro of the information and materials available on those sites. The customer accesses those sites exclusively at his own risk.

Policy Klap.ro

It is strictly forbidden to abuse the Site www.klap.ro .

Abuse any kind of use of the Site in a way that is contrary to fair commercial practices, the legislation in force or in any other way that would be likely to harm Klap.ro or its Partners in any way.

Klap.ro reserves the right to refuse or block access to some or all of the features of the Site and to restrict the processing and/or delivery of an Order if, in its reasonable opinion, there is suspicion of fraud by Users and Clients, if they have behavior that may harm the interests of Klap.ro or its Partners, or if you misuse the Site.

By using the Site and, as the case may be, registering an Order, you accept and agree to the form of distance communication (e.g., telephone, e-mail, SMS, etc.) by which Klap.ro carries out its operations.

All information used to describe the Products and/or Goods (including, but not limited to, static or dynamic images, descriptive text, graphic or video presentations) does not impose any obligation on Klap.ro, which is exclusively for presentation and information purposes. Klap.ro will make all reasonable efforts to ensure the correctness of the information regarding prices, Goods and Products and their Specifications presented on the Site.

If the prices or any other details related to the Product and/or Goods Specifications have been erroneously displayed on the Site for any reason and an order has been registered Klap.ro will inform the Customer/User by e-mail or other agreed communication in the shortest time possible in connection with such error.

Klap.ro may publish on the Site information about the Products and/or ongoing promotions, either of its own and of its Partners, within a certain period of time and within the available stock limit. There may be situations where Klap.ro will not be able to display the stock or update the data in real time, but will inform the Customer until the Order confirmation, and he will decide whether or not to accept the new conditions.

The notification received by the Customer/User by e-mail after the Order has been made regarding the taking over of an Order has the role of informing and does not represent the acceptance of the Order by Klap.ro. The order is deemed accepted by Klap.ro at the latest with the confirmation of delivery, respectively the supply of the Products and/or Goods ordered by the Customer. If the payment for an Order has been made and Klap.ro cannot accept and/or confirm it, Klap.ro will refund the amounts transferred to the Customer.

Klap.ro reserves the right to change the type or quantity of the Goods and Products in the Order, by immediately notifying the Customer about the change in the order and the Customer will decide to accept or refuse the change of the Order by canceling it, and the parties will be reinstated in the situation prior to the issuance of the Order, including by refunding by Klap.ro of any amounts collected, if any.

Following the acceptance of the order and the notification of the Customer regarding the shipment of the Products from the Order by phone call, SMS, e-mail, push notification or otherwise, the Agreement is considered concluded between Klap.ro and the Customer.

Please note that the Agreement includes these Terms and Conditions, together with all other documents that Klap.ro refers to, such as the Guarantee Certificate, the purchase invoice, etc., as well as any further agreements between Klap.ro and the Customer regarding the Order, regardless of whether they are made in writing, on electronic or physical support.

Products that are the subject of sale within a promotion or campaign of any kind will also be subject to the terms and conditions applicable to that campaign or promotion, which Klap.ro will bring to the attention of Clients/User at the time of the campaign.

Any promotion presented on the Site will be valid for the duration stated. If no duration is indicated for the conduct of the promotions, they will be valid within the limits of available stocks.

The document and information provided by Klap.ro on the Site will form the basis of the Agreement, in addition to which is the warranty certificate issued by Klap.ro for the Goods and Services purchased.

Access to the Site for the purpose of making an Order is permitted to any potential Customer acting for a legitimate purpose and intending to purchase one or more Products and Services, subject to and acceptance of these terms and conditions.

Guarantee and return of Devices

The consumer rights are in accordance with the provisions L449/2003 and OG21/1992, with subsequent additions and modifications, republished, as well as with the amendments introduced by GEO 174/2008 and Ordinance 9/2016. These rights are not affected by the guarantee provided.

The devices offered are used, tested and verified by Klap.ro specialists and subsequently reconditioned, cleaned and are put up for sale in good working order, or with the defects mentioned in the Site, visible in the photos and on the product description page, on the invoice and/or warranty certificate.

Klap.ro offers warranty for all Products reconditioned and listed on the site. The products available on the website may or may not benefit from the legal guarantee of conformity, depending on the manufacturer and the supplier. Given the nature of the Products (second-hand), the warranty will be less than the 2-year term provided by the legislation in force.

Klap.ro offers a 12-month commercial warranty for the Products available on the site, technically verified, according to the specifications found in the warranty certificate that the Customer will find electronically in the Account and/or which was provided via e-mail or in the box of the purchased product. The insurance of the commercial guarantee will be made by Klap.ro or, if necessary, by its partners, as will be mentioned in the commercial guarantee certificate. In order to be able to send a product under warranty, the Customer will have to follow the procedure indicated in the form on the account created on the site.

In the commercial guarantee certificate, the Customer will find all the information he needs, such as: the cases where he benefits from the guarantee, the locations of the partners and the way in which he can benefit from the guarantee. The commercial guarantee offered by Klap.ro does not affect the rights of the Customer as Buyer-Consumer, offered according to the law.

All devices listed on the Klap.ro Site are checked by Klap.ro, that is, not to have been reported as stolen, blocked, lost and/or with the payment of the outstanding subscription in any database. However, there are situations where devices do not appear at the time of putting up for sale on the Site as being reported in a database and be okay, and then the IMEI is found/reported in a database or in a “blacklist”. In these situations, Klap.ro will do everything possible to:

(i) provide the Customer with an identical device in exchange if it exists in stock;

(ii) change the device to a similar and/or close to what the Customer has purchased from the Site;

(iii) refund the amount paid if the two variants, (i) and (ii), are not possible and the Customer will return/refund the device exactly as it received it (with all accessories), so that Klap.ro can hand it over to the competent authorities.

In order to benefit from the warranty, the Customer must send the Product to the Klap.ro repair center, according to the data indicated in the Site and on the Warranty Certificate. The warranty offered by Klap.ro is not valid in another repair center.

Klap.ro does not offer warranty for consumables (for example, batteries, accessories, protective display sheets if applicable) or for manufacturer problems for which it does not offer warranty or warranty. Not subject to warranty: improper use of the device, improper handling, installation of unauthorized software, use inconsistent with instructions for use or other such uses, such as: installation of software that is not previously approved by Google Play / AppStore, installation of an operating system unofficial or beta, rooting of the phone, phone that is at low or high temperatures.; devices that have suffered physical impact with hard surfaces (fall, shock, etc.); defects caused by contact with liquids, compressed air or any other type of substances, whether or not they produce visible corrosion and oxidation; devices that have been opened, repaired or handled by other third parties or companies; defects caused by software updates, whether authorized or not; normal product damage as a result of use (eg screen yellowing, burn effect in, key space sweeping, eroding of buttons, tires or phone edges, coupling places, etc.); The batteries are consumables for which a 3-month warranty is granted from the time of purchase.

The warranty period begins to run from the date of purchase and applies to defects that occur under normal conditions of use. The product warranty is 12 months, except for products in the category of accessories that are not electronic products.

The repair of the product will be made within a maximum period of 15 calendar days from the date when it is received by Klap.ro, under warranty. If it is not possible to repair or Klap.ro decides that it is too expensive, the Buyer/Customer is offered a similar product, or compensation at the market value at that time. Market value is the minimum price at which a similar model can be bought as specifications and functionality.

The return period is 30 days, in case of online purchase from the www.klap.ro website for refurbished products. The buyer has the right to return the product without mentioning the reasons in the above term, applied from the date of purchase, receiving the money back, after checking the returned Product in advance. In case of repeated returns, without a real defect, Klap.ro reserves the right to refuse the return. The products you return must be in the same condition in which you received them, along with the accessories offered and the Product or Good offered under the title “GIFT” if it existed, by courier with delivery option with check package. Make sure that the product is not protected by set passwords and that you have deleted any accounts that you have defined so that the product does not contain any personal data and can be brought to the original version of the software. If you have bought several products of the same kind and want to return them all, make sure that only one has been unsealed. The return of the other products is only accepted if sealed. It is not accepted the products on which unauthorized interventions were performed, those that have traces of wear or excessive use, scratches, shards, blows, mechanical /electrical shocks, products that lack accessories. If there are different products in the return package from the form completed on the Site, after checking the package by the courier, the takeover will be refused.

The return of the accessories: the phone sheets – can be returned only if sealed (not opened, not used); phone headsets – if they have been unsealed and tested by the Buyer, they must be returned clean and sanitized, for the return to be accepted; batteries, accumulators and chargers – can be returned only if sealed. Gift cards – cannot be returned.

If the returned product and/or accessory, within the return period, is defective and there are suspicions that the defect did not exist at the time of purchase of the product, Klap.ro reserves the right to make further investigations. Within 3 days of the return will determine whether the return can be accepted together with the return of the money, or the defect was caused by the buyer, in which case the return will be refused, or the buyer will have to pay the value of the repairs that involve bringing the product to its original state from the moment of sale.

Professionals, meaning any natural or legal person, public or private, acting in the course of their commercial, industrial or production activity, craft or liberal in relation to contracts covered by the emergency ordinance no 34/2014, and any person acting for the same purpose, on its behalf or at its expense, shall not benefit from the right of return within 30 days.

IV. Klap.ro online sales policy

All tariffs related to Goods/Products and/or Services presented on the Site www.klap.ro are expressed in lei (RON) and include or not the T.V.A quota. (21%). Under the conditions provided by law, the prices of the Products presented on the Site include the Green stamp duty. The products presented on the Site are available within the available stock limit at the time of placing the Order.

If you decide to put on sale a device through the www.klap.ro Site, after completing the evaluation form or after scanning the QR code from the site, by email or by phone you will receive an information on the estimated price offer, an estimate of the amount of money you can get. You must take into account that the estimated price offer includes a Klap.ro commission, charged for the process of sale and technical and aesthetic verification and does not create a contractual obligation between Klap.ro and the User.

Following the estimated price offer, the User may choose to send your device to be checked and evaluated by Klap.ro, through one of our partners (eg courier services), according to the information provided on our Site. The estimated price offer can be adjusted, after the technical and aesthetic verification made by Klap.ro and will be communicated to the User.

In order to complete the sales process and to benefit from Klap.ro services, it is necessary to choose the method of sale, to reach your device at Klap.ro and to create an account on www.klap.ro, where you will need to provide us with your full name, an e-mail address, a phone number, the IMEI of the device you are about to send to Klap.ro the address where the device for technical and aesthetic verification can be picked up. You will find the methods of sale at the end of the evaluation process on the Site: quick sale or extended sale. You can send the device free of charge through Klap.ro courier partners or through a courier agreed by you at Klap.ro that you can find on the Site. You must consider deleting all personal data existing in the Devices, regardless of the method chosen (personally or by courier), before shipping/delivering it and unlocking them (reset to factory settings./restore to factory settings). You do not need to send accessories with your device, accessories such as charger, data cables, headphones, pouch, protective film, original box, warranty certificate, instructions for use, device manual, as they do not influence the Price Offer following the Technical verification process. In such cases, accessories are destroyed and recycled because it is impossible to store and highlight them internally. Klap.ro will not be held responsible for any loss or damage, directly or indirectly, as a result of the destruction and recycling of the accessories and by accepting the Terms and Conditions you declare that you will not request in any way the return of the accessories or the original packaging sent by you, their replacement or the equivalent of – a sum of money, regardless of whether the sales process is completed by Klap.ro.

If Quick Sale or Extended Sale is successfully completed, you will need to provide us with the necessary data to transfer your money such as your IBAN account, postal address and other additional details, if any, depending on the regulations at the time and the option you choose to transfer the amount). In the absence of a complete deletion of the information from your Klap.ro devices, you will return the products because the Technical verification process will not be possible.

The device check will be done by Klap.ro technical team or an approved Klap.ro partner, who will evaluate the devices from a technical and aesthetic point of view. If the technicians identify defects that you did not notice, you will be informed about the defects discovered by the technicians and you will decide whether you agree with the repair costs for reconditioning the devices and want to continue with the sale/reconditioning process through Klap.ro. The value of the repairs will be deducted from the final amount presented for the sale of the devices. If you do not want to continue the process of selling and/or refurbishing via Klap.ro your devices will be returned. In some cases, it is necessary to open the device to check whether it has had contact with liquids and whether it has oxidized circuits or other technical malfunctions inside. By accepting the Terms and Conditions, you provide us with your consent for this process, with the mention that Klap.ro undertakes to assemble the devices back together, without any other operations or replacement of components.

Please note that the Klap.ro verification procedure also involves checking the IMEI of your device or other unique identifier that allows the identification or signaling of a stolen, blocked or lost on that device.

If, following the verifications, we find that the device is entered in a database/black list Klap.ro reserves the right to: (i) request from you the entire amount paid to you, including with full coverage of other damages, (ii) not to transfer the amount requested if the transfer of the amount did not take place and the device will be inserted into the IMEI database/black list. In both cases, Klap.ro undertakes to alert the competent authorities and bodies and will transmit all your identification data so that they can solve the case. Klap.ro reserves the right to change the verification criteria at any time, on which we will inform you in a timely manner. These changes will not affect goods that are already listed on the Site for sale.

Klap.ro reserves the right to decide which devices will be listed on the Site to be sold. If you send a device to Klap.ro for technical verification for sale does not mean that the respective device will be listed on the Site, and Klap.ro does not assume any contractual obligation to sell the respective device.

After the completion of the Technical Verification Process, the Seller/Customer will receive a receipt ticket, which includes a final price offer (”Pricing Offer”), depending on the findings of Klap.ro technicians and which will also include Klap.ro Commission for Sale, according to the legal regulations. The price of the offer may be the same, lower or higher than the original offered within the estimated price offer. The seller will be informed about the final price offer through the Account, via e-mail, SMS, and within 5 days you will notify us if you accept or not the price offer proposed by Klap.ro.

Please read carefully all the information you receive in your Account created on the Site throughout the Sales process, as you are responsible for the answers provided.

If the Price Offer is not accepted by you within the 5-day time limit we will send your device back, according to these Terms and Conditions. Only after accepting the offer Klap.ro as a Seller, we will enter into a contractual relationship. If you do not accept the offer of Klap.ro or do not provide us with a response within the term communicated above, you have the possibility to re-enter the device either through our partner who provides courier services or through another way agreed with you. It is important to note that in order to return your device it is necessary to provide us with the return address.

Not having an address communicated and confirmed with you Klap.ro will not be able to ship the device. Klap.ro will notify the Customer (via e-mail and/or SMS) about the return of the device within 90 days to confirm the return address. If you do not provide a return address within 90 days, Klap.ro reserves the right to destroy the respective device or use it for spare parts, without being liable to pay any compensation to you as a Customer. For this, you expressly agree that after the passage of the aforementioned term, Klap.ro may recycle or destroy the good, without Klap.ro being held liable, the fault being entirely your responsibility as Seller/Client.

Klap.ro guarantees that your device will be returned in the same condition as it received for verification. If you believe that your device is in a different aesthetic condition, please notify us of this at the time of receipt of the package. Without this referral at the time of opening the package you will lose the right to signal or request any damages, which is why please check the package at the time of return because such mention after receiving will not be taken into account. By accepting the Terms and Conditions, you provide us with your consent to this clause.

V. Fast selling and extended sale

For certain devices, Klap.ro will be able to make an offer of type “Quick Sale”, through which we communicate a price and we can buy your phone, and the risk of resale and depreciation will be at Klap.ro. If you agree to the offer “Quick Sale”, you will receive the amount communicated within the offer within maximum 2 working days from the moment of completion of the technical check, without waiting until your phone will be sold on the Klap.ro website. Offer type “Quick Sale” will be lower than the Price Offer described above, but faster. All other provisions of the Terms and Conditions shall continue to apply.

If you opt for the “Extended Sale” offer your win will be higher but it is subject to a waiting time of up to 20 days, as well as the fact that the device does not require technical service interventions following the verification process. If you opt for this offer your device will be published on the Site in the form of a Product (”Product”), along with a description of it, which also includes the technical specifications identified by our technicians. Klap.ro cannot guarantee that a device for sale will be sold within a certain term. It is possible that some devices will be sold in a shorter term of 5 to 7 days, but there are also situations when the sale will last even longer and 20 days. In the case of such a normal sale (that is, not the Quick Sale type), which reaches the 20-day term and the device was not purchased through the Site, we offer you possibilities such as: (i) we will make a Klap.ro Price Offer valid at the time (ii) we keep the device listed on the site for another 20 days or (iii) we return the device back (here the provisions on returning the Products will apply), the decision being entirely yours. If your posted device will be sold, you will receive a notification in this respect, through one of the communication ways provided by Klap.ro. Following the completion of the sale (which implies the actual collection of the Price by Klap.ro and the delivery of the Product to the Buyer), we transfer the amount of the Order (“S Sale Price”), from which Klap.ro will be charged for the respective Sale, according to the consignment regulations (”Klap.ro”). For clarity, the Sale Price will be calculated as follows: The price at which your device was sold in Site – Klap.ro Commission = Sale Price for your device. Please note that there is a risk that the Price at which the product will be sold in the case of the “Extended Sale ”offer will be different from the Sale Price that we previously communicated to you, for reasons independent of Klap.ro such as depreciation, obsolete model, etc., and will not influence Klap.ro Commission. The price of the Sale will be transferred to you within a maximum of 3 working days, as long as you provide us with the correct and complete data for the purpose of making the transfer. We do not accept bank accounts other than those of the account holder. When you have sent us your bank details, you are responsible for the accuracy of the information. Klap.ro is not responsible for any other errors that may lead to the non-delivery of money to you (for example, the indication of a wrong IBAN account or another person).

Klap.ro is not responsible for any delay caused by financial-banking institutions, including payment deadlines set by them.

You are solely and directly responsible for the information provided on the Site! We do not accept bank accounts other than those of the account holder. When you have sent us your bank details, you are responsible for the accuracy of the information. Klap.ro is not responsible for any other errors that may lead to the non-delivery of money to you (for example, the indication of a wrong IBAN account or another person).

The transfer of risks on the loss or alteration of your device is the responsibility of Klap.ro only when it is handed over to us by the courier or is delivered by you personally. The risk support by Klap.ro ceases when we return the device to you, for whatever reason. During the period when the good is in transit to one of our courier partners, the liability for the good belongs to them – any problem may arise regarding the loss, integrity or damage to the good during the period in transit is exclusively the responsibility of the courier service providers, Klap.ro being completely exonerated of liability.

The transfer of ownership of the device will be made at the time when we pay the amount of money described in the Quick Sale offer, if you choose this way of sale. If you choose the Extended Sale offer, you will always remain the owner of the good you entrust to us, including when it is put up for Sale as a Product on the Site and until the moment when an Order is successfully completed through the Site www.klap.ro. In case of extended sale, based on the accepted Terms and Conditions, you authorize Klap.ro to sell the device on your behalf and on your behalf to the Buyer identified through the website www.klap.ro

VI. Purchase policy on Klap.ro

Klap.ro checks all products, aesthetically and technically, and refurbishes them before listing on the site and does everything possible to provide you with all the details and real features so that you make the right choice because it is important that the Products meet your expectations.

The devices listed on www.klap.ro are second-hand and reconditioned (products that have been used, checked, cleaned, deleted, and from a technical point of view are optimal for operation according to the provisions and specifications offered by the manufacturers and which may be the presence of certain aesthetic imperfections) in the category of mobile phones and accessories for those devices.

The access for placing an Order is allowed to any User who acts as a potential Buyer with a legitimate purpose and who intends to purchase through Klap.ro one or more Products, in compliance with these terms and conditions. By Buyer we mean any legal or natural person who has: (a) at least 16 years old or (b) at least 14 years old, who have received authorization from a parent/guardian/legal representative to be able to access the Klap.ro Site. If you have authorized a minor person to use the Klap.ro Site, you are directly responsible for all its behavior on the Klap.ro Site, including any action that the minor may take. It is strictly forbidden to abuse the Platform. Any kind of use of the Platform in a way that is contrary to fair commercial practices, the legislation in force or in any other way that would be likely to harm Klap.ro in any way or Klap.ro Partners (via ”Partners” we mean people from the same group to which Klap.ro belongs or people with whom Klap.ro has a collaborative relationship).

Klap.ro reserves the right to refuse access to some or all of the functions of the Site and to restrict the processing and/or delivery of an Order if Klap.ro is reasonably of the opinion that there is a suspicion of fraud on the part of the User, if he has a behavior that may harm the interests of Klap.ro or its Partners, or if he misuse the Site.

By using the Klap.ro Site and, as the case may be, registering an Order, you accept and agree to the form of distance communication agreed by Klap.ro, by telephone or by e-mail.

All information used to describe the Products (including, but not limited to, static or dynamic images, descriptive text, graphic or video presentations) does not impose any obligation on Klap.ro, which is exclusively for presentation and information purposes.

If the prices or any other details related to the Technical and/or Aesthetic Specifications of the Products have been misrepresented on the Site for any reason, and you as the User have placed an Order, we will inform you by email or by any other means of agreed communication, as soon as possible in connection with such error. In the Site will be presented information about the Products and/or promotions that Klap.ro has in progress, within a certain period of time and within the limit of available stock. You must bear in mind that there may be situations where Klap.ro will not be able to display the stock or update the data in real time, but the User will be informed in good time before the Order is confirmed, and he will decide whether to agree and accept or not the new conditions or limitation of the Order.

Products that are the subject of sale within a promotion or campaign of any kind will also be subject to the terms and conditions applicable to that campaign or promotion, which Klap.ro will bring to the attention of Users/Customers on the Site.

Any Klap.ro promotions valid on the Site will have a specified duration, and if a duration is not indicated for the conduct of such promotions, they will be valid within the limits of available stocks.

This notice is for information purposes and does not represent the acceptance of the Order by Klap.ro. If the User has made the Payment for an Order and cannot be accepted and honored by Klap.ro, for justified reasons (including, but not limited to, lack of stock of some Products, an erroneous update of the stock on the site, duplication of orders for the same product, etc.), the transferred amounts will be refunded to the User. Any change that occurs on an order will be communicated to the Users, and they will accept or refuse the changes to the Orders. If the Order is accepted, the Agreement is deemed concluded between Klap.ro and the User when the User receives a shipping confirmation (by phone call/SMS/e-mail or otherwise) of the Products ordered.

The Contract includes this document together with all other documents that Klap.ro refers to, as well as any further agreements between Klap.ro and the Customer, regarding the Order, regardless of whether they are made in writing, on electronic support or on physical support.

The User may contact Klap.ro by telephone and/or via e-mail and/or via the Client Account for any queries or problems related to the Order, including to identify and correct any errors that occur when entering the data. However, if Klap.ro is not informed about these issues prior to the issuance of the service notification or the start of the service, further changes will only be possible in exceptional cases, which do not involve a disproportionate effort on the part of Klap.ro and which are legally valid.

VII. Klap.ro policy on placing orders

Orders may be made exclusively on the Site and may consist of one or more Products, with or without prior registration of an account, by adding the Products to the shopping cart, By creating an Account you will have a history of your activity on the Site: you can view previously placed orders, tax invoices, warranties, etc. You must bear in mind that you cannot complete an Order without creating an account, which is not and orders may not be placed otherwise than through the Site. For support or any questions you have you can contact the Klap Support team, both by phone and e-mail, only on business days, between 9-18 hours. You may place orders at any time but they will be processed and/or checked by Klap.ro team only on business days (orders placed on a Saturday, Sunday or any day declared by law legal holiday will be processed on the next working day). You must keep in mind that adding a Product to your shopping cart, in the absence of completing the Order, does not lead to registration of an Order and implicitly does not lead to automatic booking of the Product. The order will be considered completed by the full payment by the User of the price of the Products in the Order, through one of the payment methods accepted by Klap.ro as expressly indicated on the Site and which the User can consult at the latest at the beginning of the Order formulation process. If the User chooses the payment by bank transfer/payment order/internet banking, the payment will be considered to be received by Klap.ro at the time of actual debiting of the account indicated on the proforma invoice. Once added to the shopping cart, a Product is available for purchase to the extent that the Product exists in Klap.ro stock. By creating an Account or, as the case may be, completing the Order, the User agrees and confirms that he can be contacted by Klap.ro, by any available means, by telephone, fax, e-mail, in any situation where it is necessary to contact the User for the completion and processing of the Order. The lack of a response from the User, through one of the ways of communication made available through the Site to Klap.ro requests, may lead to the invalidation of the Order.

The payment methods available for the purchase on the site are as follows: payment on delivery, online payment by card (in instalments or in full), payment by card on delivery or payment order.

VIII. Canceling orders

An order placed by the Customer may be cancelled by Klap.ro, the User/Customer will be notified simultaneously or later.and without such cancellation incurring any liability of Klap.ro towards the User in the following cases: non-acceptance of the transaction due to your bank, in case of online payment; invalidation or invalidation of the transaction by the card processor with whom Klap.ro collaborates on the grounds of insufficient funds and/or for other reasons, according to the processor’s policy, in case of online payment; failure to comply with the payment term indicated in the proforma invoice and the completion of the payment at a date after the due date, in case of payment by bank transfer/internet banking; incomplete or incorrect data provided by you at the time of accessing the site; lack of a response from you following the contact by Klap.ro in order to confirm the order; if by accessing the Site and placing the Order, the User pursues an illicit purpose or which may cause any damage to Klap.ro or its Partners; failure to comply with or to accept any terms and conditions of this document. If an Order is cancelled by Klap.ro, after the Payment by the User, Klap.ro will refund the amount of money related to the Product, except for any bank fees, which are the responsibility of the User.

IX. Delivery of orders

Klap.ro makes every effort that the delivery of the ordered products to be made within the deadline communicated before the completion of an Order on the site. The delivery time is indicative, based on previous orders from those areas and may be subject to changes. Any change regarding the delay of a delivery will be communicated, by e-mail and/or by telephone, in advance to the Customer. Klap.ro is not liable for delays in the delivery of Products that occur for reasons not attributable to it or due to fault of a carrier (i.e., courier, mail, etc.). The delivery of the products will be free of charge or for a fee, according to the information available on the site at the time of placing/completing the order.

Klap.ro will be able to subcontract a third party to deliver the Products subject to the Order and the User will be informed about the courier that will handle the shipment at the time of completing the Order on the Site, Delivery is carried out through a courier company, and the delivery time is 1-3 working days from the moment of initiating the order.

Klap.ro is not liable for the damage caused by this third party during the delivery of the respective goods, but will make every effort to remedy the situation in case of an unpleasant event.

The product will be delivered to the Customer as Buyer and Order holder. If another person will receive your parcel, you must notify us in advance in order to make the necessary changes and/or inform the courier company. Klap.ro is not liable for any damages or unpleasant situations that may arise because a person other than the Buyer or expressly indicated by him has received and/or taken over the ordered package/product. Our partner will try to deliver the package 3 times – if in all these attempts the package/product has failed to be received by you, the partner will return the package to the sender. Klap.ro reserves the right to restrict access to the Site to place a new Order through the Site, if one of your orders has not been received and/or you have not contacted the courier in this regard.

Klap.ro reserves the right to delay or cancel any delivery of the Products ordered if it cannot be honored for reasons independent of Klap.ro, which include, but are not limited to: force majeure events, wars, acts of terrorism, protests, riots, civil unrest, fires, explosions, floods, epidemics, strikes, etc.

X. Price of invoiced products. Payments

The prices of the Products and Services listed on the Site or communicated to the Customer are expressed in Lei and include or not the T.V.A.’s share (21%) according to the legislation in force. Any shipping or delivery charges are not included, unless expressly stated at the time of completion of the Order. The prices valid for the Products and Services are those displayed on the Site or communicated to the Customer when completing an Order.

Klap.ro will be able to update Product prices at any time, and such an update will replace any prices previously displayed for those Products.

For those Products and Services for which prices are not indicated and, where applicable, all additional costs of transportation, packaging, verification, evaluation or delivery, if applicable, Klap.ro will provide a price calculator or contact the Customer about them by e-mail and/or by phone or through the Account created on the Site.

For all products and services purchased/delivered Klap.ro issues an invoice and sends it electronically, by e-mail and/or to the Client account on the Site. The Customer’s duty is to provide all the necessary information according to the legislation in force for the issuance of the invoice by Klap.ro and to pay increased attention when entering the data, because Klap.ro will not be able to change the data from the issued proforma/fiscal invoices. In the case of Payments by bank transfer, a pro forma invoice will be issued initially, and after debiting the account, with the related amount written on the proforma invoice, Klap.ro will issue a tax invoice.

According to the legislation in force in Romania, when the payment by bank card is accepted, Klap.ro will not request additional payments. In the case of online payments, Klap.ro is not and cannot be held responsible for any other cost incurred by the Customer in addition to the price of the Product purchased including, but not limited to, bank transfer fees or currency conversion fees applied by the issuing bank of the Client’s card if the card issuance currency differs from the Lei (RON) currency in which the sale is made.

XI. Transfer of risk and ownership of products

Klap.ro calls third parties to perform the Delivery (such as courier services, postal services or third parties), so the risk will be transferred to the Customer at the time of delivery of the Products by that carrier, without prejudice to the rights that the Customer has towards him (for example, when the carrier damages the Products). The ownership of the Products will be transferred upon delivery, after the payment has been made, to the delivery location indicated in the Order by the Customer. The delivery will be deemed to be made by signing by the Customer of the transport document provided by the courier or on another delivery document, if applicable. Once the risk has been transferred to the Customer, Klap.ro will no longer be liable for any problems that arise, any dispute or damage suffered by the Customer being in its charge, unless the Customer benefits from the 12-month commercial warranty right offered by Klap.ro or opted for a product insurance.

XII. The return. Right of withdrawal from the contract of the Customer

The Customer has the right to unilaterally terminate the Agreement within 14 (fourteen) calendar days without having to justify the withdrawal decision and without incurring any costs other than those established by law. The right of withdrawal expires within 14 (fourteen) calendar days from: (i) the date of conclusion of the Agreement, in the case of Contracts for the provision of services; (ii) the day on which the Customer or a third party other than the carrier and which is indicated by the Customer, comes into physical possession of the Products, the or (iii) if the Customer makes a single Order for Multiple Products to be delivered separately, the day on which the Customer or a third party other than the carrier and indicated by the Customer, comes into physical possession of the last Product; (iv) in the case of delivery of a Product consisting of several batches or parts, the day on which the Customer or a third party, takes physical possession of the last Product; and (iv) in the case of delivery of a Product consisting of several batches or parts, the day on which the Customer or a third party other than the carrier and which is indicated by the Customer, comes into physical possession of the last Product or part; (v) in the case of Contracts for the regular delivery of Products for a fixed period of time, the day on which the Customer or a third party other than the carrier and which is indicated by the Customer, comes into physical possession of the first Product.

In order to exercise the right of withdrawal, the User must inform Klap.ro of the decision to withdraw from the Contract. This can be done through the return form made available through the Site, where you will find all the details related to the return.

By accessing the return form everything will be done automatically, and a Klap.ro courier will record the request and will be present at the address indicated by you to retrieve the device you want to return.

Return requests that are not submitted through the Site will not be considered! Klap.ro is not liable for any damage or additional cost that the Customer incurs if he does not follow the steps described in the Site or provides erroneous information for return. For any information regarding the return, you can contact the Klap Support team.

The Customer may also exercise the right to withdraw through the e-mail or contact form, but only if the return form is not functional on the Site due to the fault of Klap.ro. In this case Klap.ro will provide the User with a model return form for filling in. The exercise by the Customer of the right of withdrawal terminates the obligations of the Customer and Klap.ro, as the case may be: (i) to perform the Contract; (ii) to conclude a Contract, if the Customer has made an Order. Unless Klap.ro has offered to recover the Products, the Customer returns the Products or hands them to Klap.ro or to a person authorized by it to receive the Products without undue delay and within no more than 14 (fourteen) calendar days from the date on which the Customer has communicated to Klap.ro its decision to withdraw from the Agreement. The term is respected if the Products are sent by the Customer to Klap.ro before the expiration of the period of 14 (fourteen) mentioned calendar days. The Customer bears only the direct costs related to the return of the Products, unless Klap.ro agrees to bear those costs and informs the Customer about this.

Klap.ro will reimburse all amounts received as payment from the Customer, including, where applicable, the costs of delivery, without undue delay and in any case no later than 14 (fourteen) days from the date on which it is informed of the Customer’s decision to withdraw from the Agreement. The customer must take into account the following aspects regarding the returned products to Klap.ro: (i) the returned products must be unlocked, unparolated, free of any kind of tasks, passwords, fingerprints, PIN codes, security codes or any other blocking mechanism; be free of any personal data or any other files; be returned according to the manufacturing settings (reset to factory settings). If the returned Product is blocked with access passwords (global account, icloud account, etc.), Klap.ro will not be able to process the payment of the amount of money related to the return until the Customer will delete (remotely, where possible) the information related to those accounts and any other data, personal or not, that exists on the device; (ii) the amounts paid for the returned products will not be refunded to the Customer if they have undergone interventions (authorized or not) in locations other than those expressly indicated by Klap.ro or have been dissolved by the Customer or other persons, whether or not they were authorized services. The reimbursement of the amounts is made through a bank account (IBAN) communicated by the Client, the latter being unable to opt for another way of reimbursement, unless Klap.ro expressly provides this possibility. Amounts cannot be refunded by postal order, cash or otherwise, if Klap.ro does not expressly provide this possibility to the Customer. Klap.ro can refund the amounts only after receiving the Products that were the subject of the Contract or after receiving proof from the Customer that he sent the Products to Klap.ro, taking into account the nearest date.

According to the legislation in force applicable to distance contracts, the right of withdrawal is not ensured in the following cases:

(i) service contracts, after the full provision of services, if the execution started with the express prior consent of the Customer and after he confirmed that he has become aware that he will lose his right to withdraw after the full execution of the Contract by Klap.ro;

(ii) the supply of Products made to the Customer’s specifications or clearly personalised;

(iii) the supply of Products which are liable to deteriorate or expire rapidly;

(iv) the supply of Sealed Products which cannot be returned for health protection or hygiene reasons and which have been unsealed by the Customer;

(v) the supply of Products which are, after delivery, according to their nature, inseparably mixed with other elements;

(vi) contracts in relation to which the Customer has specifically requested that Klap.ro travel to his home to carry out urgent repair or maintenance work. If, on the occasion of such a visit, Klap.ro provides other services than those expressly requested by the Customer or provides other products than spare parts indispensable for the execution of the reconditioning or repair work, the right of withdrawal applies to those additional services or products;

(vii) products/services for which it is not possible to return the products according to the legislation in force (eg: tickets to events, food, cosmetics, gift vouchers, etc.);

(viii) the delivery and purchase of the Products by legal entities, unless Klap.ro decides to grant this facility.

In view of the above-mentioned general provisions, Klap.ro does not ensure the right of withdrawal of the Buyer – Consumer in the following cases: (i) for Products that have physical changes, blows, chipping, scratches, shocks, liquid immersion including exposure to water vapour (not signaled as aesthetic defects within the first 48 hours of receipt of the product), traces of excessive use and/or unauthorized interventions; (ii) products whose software has been modified (eg jailbreak, root, unauthorized software installation, etc.) in one form or another – Klap.ro reserves the right to refuse the reimbursement of the amounts related to the right of withdrawal if it is found, following the technical verifications, that the Product has been altered from the software point of view even if it is restored to its original state by the Buyer prior to the exercise of the right of withdrawal and the transmission of the Product; (iii) in the case of protection sheets, their return is only accepted if they are sealed.

When receiving the Product as a result of exercising the right of withdrawal, Klap.ro will proceed to its technical and aesthetic verification. According to the law, the Buyer-Consumer is entitled to reimbursement of the amounts if the Products are returned in the same state in which they were received, with all the accessories and have a normal wear and tear, according to a standard use. Any deviation and shortcomings from these will be considered by Klap.ro to reduce the amount to be reimbursed, the amount being set taking into account the costs incurred by Klap.ro to return the Product to its original state, as it was handed over to the Buyer-Consumer. The amount to be refunded will be communicated to the Buyer – Consumer only after the inspection. If the Buyer-Consumer does not agree to this amount or if, as a result of the inspection, Klap.ro finds that the Product can no longer be returned to its original state (whether or not this operation involves reasonable costs), Klap.ro will offer the Buyer-Consumer the opportunity to return the Product at the expense of the latter.

XIII. Contact form. Newsletter – commercial communications

By filling in the contact form available on the Site and sending it, the User and/or the Customer allow Klap.ro to contact him by any means available exclusively for the stated commercial purpose and for the purpose of achieving this purpose, including by accessing electronic means, namely e-mail and/or SMS. Accessing the Klap.ro Site, using the information presented within it, visiting the pages or sending e-mails or notifications addressed to Klap.ro is done electronically, by telephone or by any other means of communication available to the User and/or the Customer. Thus, Klap.ro will obtain the prior consent of the User and/or the Customer for receiving information and or notifications from Klap.ro in electronic format and /or by telephone, including communications by e-mail, SMS or by advertisements on the Site.

Klap.ro reserves the right not to respond to requests of any kind, which are unrelated to the products and services present on the Site or to a Contract concluded with a User or Customer, received through any means of communication (electronic, phone call, SMS, etc.).

When you create an Account on the Site or access the services or products, Klap.ro requests your prior consent to receive newsletters and/or alerts from Klap.ro and its collaborators and/or Partners to carry out such communications, transmitted by electronic mail (e-mail, SMS) and/or telephone.

The option of the agreement issued by the Customer or the Registered User is freely expressed, may be changed or withdrawn at any time.

The user may at any time revoke his consent to such commercial communications by:

a. using the special link within the Content, by accessing the dedicated link of “unsubscribe”, any newsletters and/or alerts received;

b. by calling Klap Support, both by phone and e-mail – in this case, the revocation will take effect no later than 48 (forty-eight) hours after the initiation of the request, without any further obligation of either party to the other.

c. ticking the option of withdrawing consent in the dedicated section on the Platform.

Data taken from a User and/or Client for the purpose of sending newsletters and /or alerts, may be used by Klap.ro within the limits of the Privacy Policy and the prior consent expressed by it.

The waiver of receiving newsletters and/or alerts does not imply the waiver of the acceptance generally granted for the provisions of the Klap.ro Terms and Conditions.

Klap.ro reserves the right to select the User and/or the Customer who has previously expressed his consent to receive newsletters and notifications, as well as the right to remove any User from its database justifiably, without any subsequent commitment from Klap.ro.

You may address Klap Support to receive information about any decision and/or action taken for the purposes of this Article.

XIV. Intellectual property

Property The content, as defined in the preamble, including but not limited to trade names, trademarks, copyrights and any other intellectual property rights recorded or pending registration in respect of the Products and Services owned or used by the Site, stylized representations, trade symbols, logos, static images, dynamic images, text and/or multimedia content presented on the Site they are the exclusive property of Klap.ro and, as the case may be, the licensors of the Site. You are not allowed to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, include any content in any context other than the original intended by Klap.ro, include any content outside the Klap.ro Site, modify or display the content, in the absence of the express consent expressed by Klap.ro.

The User or the Customer shall not have any rights or claims regarding the content and only with the prior written consent of Klap.ro will be able to copy, transfer and /or use the Content only for personal or non-commercial purposes, as well as in relation to Klap.ro. If Klap.ro grants the User or the Customer or other interested third party the right to use, in the form described in a separate user agreement, certain content, to which they have or can gain access following this agreement, the right of use extends only to those or those contents or sections defined in the agreement for the period of its existence or the period defined in the agreement and within the limits of the agreement. The existence of any use agreement expressly concluded by Klap.ro with a third party, a User or a Client does not represent a Contractual commitment from Klap.ro to that third party, User or Customer that obtains access to the content or certain sections of the Site, in the sense that Klap.ro has the right to modify, the update or complete in any way and at any time the content of the Site or its sections, during or after the expiration of the Agreement.

It is strictly forbidden to use the content of the Site for purposes other than those allowed by Klap.ro. Violation of the presence of the sections, gives Klap.ro the right to take the necessary legal measures against the unauthorized use of the content of the site, in order to repair any material and image damage caused to Klap.ro.

Posts, product reviews and all content that the Customer posts through the Site are the sole responsibility of the person who created such content. Although Klap.co.uk does not routinely monitor content posted by Users and Customers, we reserve the right to do so and remove content and posts that violate these Terms and Conditions (or applicable law) that Klap.com is aware of, but we have no obligation to do so. The User/Customer shall keep safely the username and password of the Account created on the Site, being the only one responsible in case of fraudulent use of them by a third party.

Any other use, including the reproduction, modification, distribution, republishing, transmission, or display of the content of this Site is not permitted without the prior written consent of Klap.ro.

All content of the Klap.ro Site, such as design, text, graphics, logos, images, audio clips, are protected by copyright and other laws in the field of intellectual property in force and are the property of Klap.ro. Klap.ro reserves the right to modify at any time all the content of the Site such as images, design, text, graphics, logos, audio clips and other aspects related to the presentation content.

XV. Complaints, Complaints

Clientul sau Utilizatorul poate contacta Klap.ro la adresa de e-mail din secțiunea info@klap.ro, la numărul de telefon +40771.222.555 și/sau prin intermediul formularului de mesaj disponibil în Site, în pagină Klap Suport, pentru orice nelămurire, sesizări, reclamații sau probleme, în legătură cu Serviciile și/sau Produsele, inclusiv pentru a identifica și corectă eventuale erori care au loc cu ocazia introducerii datelor cu caracter personal. Sesizările și reclamațiile astfel recepționate vor fi soluționate de Klap.ro între 1 (unu) – 30 (treizeci) de zile calendaristice de la primirea lor.
