INFORMATION NOTE ON THE PROCESSING OF PERSONAL DATA<\/strong><\/p> \n\r\n\r\n \n

Klap Tech SRL Klap.ro Site Administrator (hereinafter referred to as ” Klap.ro “, “Society”), having its registered office in Str. Turturelelor No. 48, Floor 1, Room 1.2A, Sector 3, Bucharest, 030882, registered under registration no. J2019016570409, having unique tax registration code RO41981934 (\u201eP\u201d) processes personal data in compliance with European and national legislation on the protection of personal data, including Regulation (EU) 2016\/679 Of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data and the repeal of Directive 95\/46 \/EC (\u201eGeneral data protection regulation\u201d or \u201eGDPR\u201d).<\/p> \n\r\n\r\n \n

For the purpose of concluding and executing this Agreement, for the purpose of invoicing the services offered by Klap.ro and their payment, for the settlement of requests, complaints or for the fulfillment of its legal obligations, Klap.ro will process your data. relevant personal, such as:<\/p> \n\r\n\r\n \n

a) contact and identification data: name, surname, address, e-mail address, telephone number;<\/p> \n\r\n\r\n \n

b) bank account information, credit card \/debit held;<\/p> \n\r\n\r\n \n

c) delivery location information and device return location;<\/p> \n\r\n\r\n \n

d) information on unique device codes (eg IMEI);<\/p> \n\r\n\r\n \n

e) the information contained in the documents or any other material containing personal data that you make available for the performance of this Agreement;<\/p> \n\r\n\r\n \n

f) data related to your correspondence with the Operator;<\/p> \n\r\n\r\n \n

We may also collect information from you. by several means, including but not limited to telephone calls, customer service contacts, websites and other sources, including business partners and third-party service providers.<\/p> \n\r\n\r\n \n

If you transmit to the Operator any personal data belonging to\/referring to any other natural person, which is not part of this contract, you assume that you have informed and obtained the express consent to the disclosure of such data to the Operator. <\/p> \n\r\n\r\n \n

Thus, the processing of personal data will be carried out only if: the processing is necessary for the conclusion or performance of a contract, in order to comply with a legal obligation of the Operator, on the basis of your express and free consent, if applicable, for the purposes of the legitimate interests of the Operator or of a third party;<\/p> \n\r\n\r\n \n

The operator will process your data in order to:<\/p> \n\r\n\r\n \n

a) managing any request from you;<\/p> \n\r\n\r\n \n

b) the performance of the contractual relationship;<\/p> \n\r\n\r\n \n

c) compliance with the legal obligations of the Operator (for example: reporting obligations to tax authorities);<\/p> \n\r\n\r\n \n

d) the management of any requests from the authorities;<\/p> \n\r\n\r\n \n

The controller may communicate your personal data to third parties, such as:<\/p> \n\r\n\r\n \n

a) consultants, experts or external partners of the Operator providing assistance to the company (eg external lawyers; courier companies)<\/p> \n\r\n\r\n \n

b) public authorities, courts or arbitral tribunals<\/p> \n\r\n\r\n \n

c) service providers: The operator may contract service providers, agents or contractors to assist him in providing his services.<\/p> \n\r\n\r\n \n

Unless otherwise provided by law, you have the following rights:<\/p> \n\r\n\r\n \n

a) the right of access, namely the right to obtain confirmation from the Operator that he is processing your personal data, as well as access to and provision of information about the processing;<\/p> \n\r\n\r\n \n

b) the right to rectification which relates to the correction without undue delay of inaccurate personal data and\/or the completion of incomplete data;<\/p> \n\r\n\r\n \n

c) the right to erasure\/the right to be forgotten, that is, the right to delete, without undue delay, the personal data collected, if such data are no longer necessary for the purposes for which they were collected and there is no other legal basis for the processing, the data have been illegally collected or the data must be deleted for compliance with a legal obligation;<\/p> \n\r\n\r\n \n

d) the right to restriction of processing, which applies if (i) you dispute the accuracy of the personal data, (i) the processing is unlawful and you oppose the erasure of the personal data by requesting instead the restriction of processing (iii) The controller no longer needs your personal data, but you request them for the establishment, exercise or defence of legal claims (iv) you have objected to the processing for the period during which it is verified that the legitimate interests of the Controller in the processing of personal data prevail over your rights;<\/p> \n\r\n\r\n \n

e) the right to object to the processing, unless the Controller demonstrates that he has legitimate grounds to process your data, grounds prevailing over your interests, rights and freedoms or for the establishment, exercise or defence of legal claims;<\/p> \n\r\n\r\n \n

f) the right of portability, namely your right to receive the personal data, which you have provided for the purposes indicated in the presence, in a structured format, which is currently used and which can be read automatically, as well as the right to send these data to another operator;<\/p> \n\r\n\r\n \n

g) the right to lodge a complaint with the National Supervisory Authority for Personal Data Protection (ANSPDCP) at its headquarters in G-ral Gheorghe Magheru Boulevard no. 28-30, sector 1, Bucharest, postal code 0103336, anspdcp@dataprotection.ro<\/a>;<\/p> \n\r\n\r\n \n

h) the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects on you or similarly affects you, unless such processing is required or permitted by law.<\/p> \n\r\n\r\n \n

These rights may be exercised by sending a written request:<\/p> \n\r\n\r\n \n

b) by e-mail, to: info@klap.ro<\/p> \n\r\n\r\n \n

Your data will be processed during the entire period of the contractual relations and for a reasonable period, after the conclusion of the contractual relations, in order to comply with the legal obligations of the Operator or to protect its legitimate interests.<\/p> \n\r\n\r\n \n

The controller will keep the personal data for as long as necessary to fulfill the purpose of processing such data.<\/p> \n\r\n\r\n \n

The Controller shall make every reasonable effort to protect your personal data in its possession or control by establishing reasonable security measures to prevent unauthorised access, collection, use, disclosure, copying, alteration or deletion, and other similar risks.<\/p> \n\r\n\r\n \n
